Arrest Definition & Meanings | Laws of Arrest in Pakistan

Arrest Definition and Meanings
Chapter 5 of Criminal Procedure Code is defines the arrest. Sections 46 to 67 are about the arrest and how it is made.
First of all we have to define what is arrest? Arrest is not defined in Cr.P.C but we can define it as, “A persona can be said to be arrested when he is actually touched or confined by police officer or other person in accordance with law provided”.
Procedure of Arrest/How to made arrest
Under section 46 of Criminal Procedure Code, “in making the arrest police officer or any other person making the arrest shall actually touch or confine the body of persona to be arrested unless there be submission to the custody by words or action”.
Essentials of Arrest

  • A police officer or an other person authorized by law can arrest
  • Actual touch and confine
  • Submission to the custody by words or actions

When there is resistance to arrest
The police officer or any other person authorized to arrest may use all means necessary to effect the arrest if;

  • Such persona forcibly resists the Endeavour to arrest
  • Attempt o evade arrest
  • But he cannot cause death of such persona during arrest (except in case when person accused of an offence punishable with death or imprisonment of life).

Search for arrest

  • Search of place entered by person sought to be arrested
  • Procedure where ingress not obtainable
  • When there are chances that accused will escape, police officer can break open any door or window of house
  • Notice to ladies of house in case of ladies in house is necessary
  • Power to break open doors and windows for purpose of liberation
  • No unnecessary restraint to prevent this escape
  • Search of arrested person
  • Mode of searching women
  • Power to seize offensive weapons

    Sir please answer is it necessary to arrest the nominated person in FIR of u/s 420, 468, 471 PPC. when fresh FIR is registered against him.

      yes it is necessary to arrest them because these are cognizable offences

    Sir plz tell me one thing. Is any Police officer have power to arrest a local person on the basis of doubt or the complaint by any locality.

    Sir, kindly tell whether there is any law which stipulates that women suspects/prisoners must be kept in separate lockup of a police station. As there are only a few police stations in Pakistan, I want to find out what and which law makes it necessary for females to be kept in separate lock-ups than those of men.

      there is no provision of law to keep woman in police station lockup… immediately after arrest police is bound to bring the women accused to concerned magistrate who can either release her on bail or sent to the judicial lock up for women. Under no circumstances a woman can be kept in police station lockup

      it depends upon the nature of complaint.. if offence falls in certain category person can be arrested.

    can a police man can arrest high profile personality with out warrent or any order?? or he can need only FIR

      in law there is no difference between high profile person and ordinary citizen.. all are equal in eye of law. so yes Police officer can arrest anybody who is involved in commission of congnizable offence means against whom an FIR is on record.

      after acquittal citizen can file suit for damages. there is also provision in Cr. P C i.e. section 182

    Can a police official without general shoot order shoot an accused, charged for offence punishable with death or for life imprisonment.
    Or he shoot on feat?
    Or can shoot on head?
    Or can made an areal firing to afraid the accused?

      Legally he should not shoot person if person surrender but routine here is that police officers shoot people in fake encounters on pretext that they attached on Police

    Is there any authority police officer (male) have to arrest woman without presence of female officer from a public place particularly (Madrasa) under offence of 489-F (cheque dishonoured) because the lady was not found at home during raid.
    If not what would be potential punishment for the police officer?

      No, male police officer cannot arrest female accused
      formal complaint must be lodged against police officer for departmental action
