Letter of Administration and Succession Certificate Act 2019
The Purpose of this Act is to provide for an efficacious and speedy mechanism for facilitating issuance of Letter of Administration and Succession Certificates. The Act also aimed at curtailing fraud and forgery in the matters related with the Succession Certificates.
In Pakistan legal heirs have to suffer the lengthy court procedures in order to get Succession Certificates and Letter of Administration. Generally Letter of Administration is used for the immovable property and Succession Certificate is used for movable property. It also put huge burden on the courts in country and it consumed lot of court time in the cases related with succession certificates. Letter of Administration and Succession Certificate Act 2019 is aimed to reduce the burden on the courts and also to facilitate the citizens of Pakistan.
Under this new law, National Database and Registration Authority (NADRA),which is described as “Authority” in this law, is responsible for the issuance of Letters of Administration and Succession Certificates.
Under section 4 of this Act, The NADRA shall establish a Succession Facilitation Unit for the purpose of receipt, processing and assessment of applications for the grand of Succession Certificates. Now a person can only contact with court if the Authority declines to process application for issuance of the Letter of Administration or Succession Certificate (as mentioned in the section 10).
Currently this Act is only for the Islamabad City and extends to the Islamabad Capital Territory.
